These terms cover your use of this website and any work you buy from White Pine Web Design ("we," "us"). By using the site, placing an order or approving a quote, you agree to them. If a signed agreement or written quote says something different, that document controls for that project.

Business use

Our services are for businesses and organizations. By buying from us, you confirm that you're acting for a business and have authority to approve the work.

Prices, quotes and sales tax

Our prices are set by the job, based on what that work usually costs, not by the time it takes us. When you order online, the price at checkout is locked in for what's listed on that order page. For anything else, the price that counts is the one on the written quote you approve. Totals from the price builder are estimates, not an offer. Prices can change for future orders. If we posted a price by obvious mistake, or can't do the work, we'll tell you and refund what you paid for work not done. Work outside your order or quote is quoted first. Where sales tax applies, we add it to your quote.

Payment

Online payments are processed by Stripe. For website projects, you can pay in full or pay half to start, with the balance due before launch or file handover. Monthly and yearly plans bill in advance and renew automatically until canceled. Deposits pay for scheduling and work begun, and aren't refundable once work has started. If a project ends early, you pay for work completed, and we refund any prepaid amount for work not started.

If a payment is more than 14 days late, we may pause work and services, and we may charge a late fee of up to 1.5% a month, or the highest amount the law allows if that is lower.

Revisions, approvals and delays

Website projects include two rounds of changes. More rounds or new requests are quoted first. If we ask you to approve something and don't hear back within 7 days after a reminder, we may treat it as approved. If a project stalls for 30 days waiting on you, we may close it and bill for the work done. We can reopen it later, and a new quote may apply.

What you provide

You're responsible for giving us accurate information and the access we need. You confirm that you have the rights to everything you give us, including logos, photos and text, and that your business claims, licenses, credentials, prices, testimonials and offers are true and allowed. Please review every page before it goes live. Your approval means you've checked the content for accuracy.

You're responsible for your own legal and regulatory duties, including your own privacy notice, industry rules and advertising rules. We don't give legal, tax or compliance advice.

Ownership

When your project is paid in full, we assign the finished website and the written content we created for it to you, in writing. Until then, we keep those rights and you may not use the work beyond reviewing it. We keep our general know-how, tools and reusable building blocks, and you get a permanent license to use any of them that are part of your site. Stock images, fonts, plugins, platforms and other third-party items stay under their own licenses and fees. Unless you tell us no in writing, we may list your project in our portfolio once it's public.

Your domain, Google Business Profile, ad accounts and analytics should stay in your name. If we manage them, you give us permission to do that work until you remove our access.

Software and AI-assisted tools

We use software in our work, including AI-assisted tools, and our team reviews what we deliver. Material made with AI assistance may have limited or no copyright protection, and similar wording or images could appear elsewhere. So we don't promise that any material is exclusive to you, and we can't guarantee that a logo or name is free to use or can be registered. Check with a trademark attorney before relying on one.

No guarantee of results

No one controls Google, other search engines or AI tools. We don't guarantee rankings, placement, mentions in AI answers, traffic, leads, sales or ad results. Any examples, demos and sample sites on this site use made-up businesses and numbers, and aren't a promise of what you'll get.

Accessibility

If we provide an accessibility test or report, it covers only the pages, standard and date listed in it. It isn't a legal certification, and it doesn't promise that your site meets the Americans with Disabilities Act or any other law. Later edits can change the results.

Hosting, care and outside services

We aim for reliable service, but we can't promise that sites, email or tools will never go down. We rely on outside companies for hosting, email, payments and software, and we aren't responsible for their outages, price changes, policy changes or account decisions. Keep your own copies of anything important, even if your plan includes backups. Security can be improved but never made perfect.

Care and Growth plans include the monthly work described on your quote. Small edits are capped as listed, and unused edits don't roll over.

Canceling and handover

Either of us can end a monthly plan with 30 days' written notice. Email is fine. Fees already paid aren't refunded for the current period. If your account is paid up, we'll give you your site files and content in a standard format within 30 days of your request, and we'll release any accounts we manage for you. We may end services right away for nonpayment, illegal use, abuse or a security risk. Hosted services stop when your plan ends, so move your site before then.

Things we don't take on

We may decline any project. We don't build sites for illegal activity. Healthcare, financial and other regulated data, including patient information, card numbers and government ID numbers, needs a separate written agreement before it goes through anything we build or manage. Online stores use the payment provider's hosted checkout unless we agree otherwise in writing.

Using this website

This site and its content belong to us. You may view it for normal business purposes, but you may not copy it, scrape it for resale, disrupt it or misuse it. Links to other sites are for convenience, and we aren't responsible for them. Information here is general and may be out of date.

Disclaimers

Except as stated in a signed agreement, this site and our services are provided "as is" and "as available," without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.

Limit of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, lost business or lost goodwill. Our total liability for all claims related to the site or our services is limited to the greater of $500 or the amount you paid us for the affected service in the 12 months before the claim.

Indemnity

You agree to cover our reasonable costs, including attorney fees, if a third party brings a claim because of content or information you provided, your business or claims, or your use of the work after we delivered it, to the extent the claim isn't caused by our own wrongdoing.

Disputes

Please contact us first, because most problems can be solved quickly. If not, we'll both try mediation in good faith before filing suit, except for unpaid invoices or urgent court orders. Michigan law applies, without regard to its conflict of law rules. Any lawsuit must be brought in the state or federal courts located in Michigan, and you agree those courts have jurisdiction. To the extent the law allows, claims must be brought individually and not as a class action, and both of us waive a jury trial.

General

If part of these terms can't be enforced, the rest still applies. Neither of us is responsible for delays caused by events outside our reasonable control. You can't transfer your rights under these terms without our written consent. We may update these terms by posting a new version with a new date, and changes apply going forward, not to a quote you've already approved.
